FL v. George Pino

George Pino, a fifty-five-year-old real estate broker from Doral, was charged with two second-degree felonies, vessel homicide and manslaughter, both stemming from the death of seventeen-year-old Lucy Fernandez. The State alleged that on Labor Day weekend of 2022, Pino ran his 29-foot Robalo at a high rate of speed through a crowded Biscayne Bay channel and drove it into a fixed concrete marker, capsizing the boat and throwing fourteen people, twelve of them teenage girls, into the water. Prosecutors alleged that this was not a simple accident but reckless operation, a conscious disregard for the safety of the children aboard, and that it killed Lucy and left her classmate Katy Puig with a traumatic brain injury. Pino pleaded not guilty and maintained that a wake from a passing boat caused him to lose control.

The trial turned less on the crash itself than on the investigation that followed it. State wildlife officers never tested Pino for alcohol on the night Lucy was dying, even after pulling 61 empty bottles and cans off the boat, and the agency ruled alcohol out within days without ever running the test its own manuals called for.
